Terms of Service

These Terms of Service ("Terms") govern your use of the InkFirst iOS application ("InkFirst", "the app", "we", "our"). By downloading or using InkFirst, you agree to these Terms. If you don't agree, please do not use the app.
1. What InkFirst is
InkFirst is a private journal that uses Apple's Screen Time framework to gate access to apps you choose. To unlock the apps you've blocked, you write a journal entry that meets a configurable word count. Optional AI features help you reflect on your writing and produce a long-form "Life Book" over time. The journal is private to you and stored on your device.
2. Subscriptions and billing
InkFirst offers an annual subscription with a free trial period. Pricing is shown in the app at the point of purchase.
Apple's required disclosure
Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period. Your iTunes account will be charged for renewal within 24 hours prior to the end of the current period at the price shown in the app. You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase. Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription.
Refunds
Apple, not InkFirst, processes all payments and refund requests. To request a refund, visit reportaproblem.apple.com and choose your InkFirst purchase. We do not have direct access to your billing data and cannot process refunds on Apple's behalf.
3. Eligibility
You must be at least 13 years old to use InkFirst. By using the app, you represent that you meet this age requirement. If you are between 13 and 18, you should review these Terms with a parent or guardian.
4. Your content
Everything you write inside InkFirst — your journal entries, your Life Book chapters, your Glossary edits — is yours. You retain all rights to your content.
By using AI features, you grant InkFirst a limited, non-exclusive, revocable license to transmit your journal text to AI providers on your behalf for the sole purpose of returning a result to you (analysis, reflection, chapter prose, etc.). This license terminates when the request completes; we do not retain a server-side copy.
You are responsible for what you write. Don't use InkFirst to plan or commit illegal acts, harass others, or generate content that would violate the Terms of any AI provider we route to (e.g., sexual content involving minors, content designed to incite violence, etc.).
5. Acceptable use
You agree not to:
- Reverse engineer, decompile, or disassemble InkFirst, except to the extent permitted by applicable law.
- Bypass or attempt to bypass authentication, rate limits, or the AI proxy.
- Use InkFirst in a way that would violate the App Store's terms or any AI provider's usage policy.
- Resell, redistribute, or sublicense your subscription.
6. Intellectual property
InkFirst, including its name, logo, app design, code, prompts, and AI orchestration, is the intellectual property of its developer. These Terms grant you a personal, non-transferable, revocable license to use the app on your iOS devices for as long as you comply with these Terms.
7. AI-generated content
InkFirst uses third-party AI models (Groq, OpenAI, Google) to produce reflections, chapter prose, and other content based on what you write. AI output is generated probabilistically and may occasionally contain inaccuracies, awkward phrasing, or unexpected content. We do not warrant that AI output will be error-free, factually accurate, or suitable for any particular purpose. Treat AI output as a suggestion to review, not as authoritative truth.
8. Disclaimer of warranties
InkFirst is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that any AI feature will produce a particular outcome.
InkFirst is a journaling tool, not a medical, mental-health, or therapeutic product. Nothing produced by the app — including mood scores, pattern alerts, or reflective text — is medical advice, a diagnosis, or a substitute for professional care. If you are experiencing a mental-health crisis, please contact a qualified professional or call the 988 Suicide & Crisis Lifeline.
9. Limitation of liability
To the fullest extent permitted by law, InkFirst and its developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or loss of goodwill, arising from or related to your use of the app — even if advised of the possibility of such damages.
Our total cumulative liability for any claim arising under these Terms is limited to the amount you paid InkFirst (via Apple) in the twelve months preceding the event giving rise to the claim, or USD $50, whichever is greater.
10. Termination
You may stop using InkFirst at any time by deleting the app from your device and (if applicable) cancelling your subscription via Apple's settings. We may terminate or suspend your access if you materially breach these Terms.
Sections 4 (Your Content), 6 (Intellectual Property), 8 (Disclaimer of Warranties), 9 (Limitation of Liability), 11 (Governing Law), and 12 (Dispute Resolution) survive termination.
11. Governing law
These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-law provisions.
12. Dispute resolution
Any dispute arising out of or relating to these Terms or InkFirst will be resolved in the state or federal courts located in Snohomish County, Washington, and you and InkFirst consent to the personal jurisdiction of those courts.
Where required by Apple's terms, claims may instead be brought in a different forum as specified by Apple's standard agreement.
13. Apple's role
These Terms are between you and InkFirst, not between you and Apple. Apple is not responsible for InkFirst or its content. In the event of any failure of InkFirst to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to InkFirst.
Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms with the right to enforce them against you.
14. Changes to these terms
We may update these Terms occasionally. Material changes will be announced in-app before they take effect. Continued use of InkFirst after a change means you accept the updated Terms. The "Last updated" date at the top of this page reflects the most recent revision.
